Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using CAD60 (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

You must be at least 18 years of age to create an account or use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Definitions

  • “Service” means the CAD60 platform available at cad60.com, including all features, tools, and content.
  • “User” or “you” means any individual or entity that accesses or uses the Service.
  • “Account” means a registered user account created via Google OAuth sign-in.
  • “Drawing Pack” means the fabrication drawings generated by the Service, including orthographic views, dimension lines, and title blocks, delivered as PDF or SVG files.
  • “Subscription” means a paid plan that grants access to premium features of the Service.
  • “User Content” means any content you upload to the Service, including company logos, saved presets, and saved job configurations.

3. Service Description

CAD60 is a parametric fabrication drawing generator for metal gates and fencing. The Service allows you to:

  • Select from a catalogue of parametric gate and fencing models
  • Configure dimensions and parameters to match your project requirements
  • Preview designs with an interactive 3D viewer
  • Generate professional fabrication drawing packs with orthographic views, dimension lines, and title blocks
  • Download drawing packs as A4 PDF files
  • Export 3D geometry as STEP files for use in CAD software (paid plans only)

The Service is provided as-is and may be updated, modified, or expanded at any time without prior notice for non-material changes.

4. Account Registration

Certain features of the Service require you to create an Account. Account creation is handled through Google OAuth. By signing in, you authorise CAD60 to receive your name and email address from Google.

You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your Account by protecting your Google account credentials
  • Notify us immediately of any unauthorised use of your Account
  • Accept responsibility for all activity that occurs under your Account

Each individual may maintain only one Account. CAD60 reserves the right to suspend or terminate duplicate accounts.

5. Subscription Plans and Pricing

The Service offers the following tiers:

  • Explorer (Free) — Access to the configurator, 3D preview, and up to 3 lifetime watermarked PDF downloads. No STEP export.
  • Fabricator (Paid) — Unlimited clean (unwatermarked) PDF downloads, STEP file export, custom company logo on title blocks, full title block customisation, and saved jobs (up to 50). Available on monthly or annual billing cycles.
  • Fleet (Enterprise) — Custom pricing and features for organisations with high-volume requirements. Contact us for details.

All prices are displayed in Australian Dollars (AUD) unless otherwise stated. Current pricing is available on the pricing page. CAD60 reserves the right to change pricing at any time, with at least 30 days’ notice to existing subscribers before any price increase takes effect on their subscription.

6. Free Trial

CAD60 may offer a free trial period for the Fabricator plan. At the end of the trial, your Subscription will automatically convert to a paid Subscription at the then-current rate unless you cancel before the trial period ends. You will not be charged during the trial period. Trial eligibility is limited to one trial per user.

7. Payment and Billing

All payments are processed securely by Stripe. CAD60 does not store your credit card or payment details directly. By subscribing, you authorise Stripe to charge your chosen payment method on a recurring basis in accordance with your selected billing cycle (monthly or annual).

Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. If a payment fails, CAD60 may restrict access to paid features until the payment issue is resolved. Stripe will attempt to retry failed payments automatically according to its retry schedule.

You are responsible for any applicable taxes, duties, or charges imposed by your jurisdiction in addition to the Subscription price.

8. Cancellation and Refunds

You may cancel your Subscription at any time through the billing management page in your account settings, which links to the Stripe Customer Portal. Upon cancellation:

  • You will retain access to paid features until the end of your current billing period
  • Your Account will automatically revert to the Explorer (free) tier when the billing period ends
  • No partial refunds are issued for unused time within a billing period

Refund requests for exceptional circumstances may be submitted through our contact page and will be considered on a case-by-case basis at CAD60’s discretion.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorised access to the Service, its systems, or other users’ accounts
  • Interfere with, disrupt, or place an undue burden on the Service or its infrastructure
  • Upload malicious content, viruses, or attempt to exploit security vulnerabilities
  • Use automated tools, bots, scrapers, or scripts to access the Service beyond normal usage patterns
  • Reverse engineer, decompile, or disassemble any part of the Service or its underlying software
  • Resell, redistribute, or sublicense access to the Service or any output generated by the Service without authorisation
  • Impersonate another person or entity, or misrepresent your affiliation with any person or entity
  • Circumvent any access controls, usage limits, or security measures of the Service

CAD60 reserves the right to suspend or terminate your Account if you violate these acceptable use provisions.

10. Intellectual Property

Your drawings: You retain full ownership of any Drawing Packs generated using your input parameters. CAD60 claims no ownership over the specific drawings you produce.

The platform: The CAD60 platform, including its source code, parametric models, algorithms, design, user interface, branding, and documentation, is and remains the exclusive property of CAD60. Nothing in these Terms grants you any right, title, or interest in the platform beyond the limited right to use the Service as described herein.

Community models: Any community-contributed models made available through the Service are subject to their respective licences as specified by their authors.

11. User-Generated Content

You may upload User Content to the Service, including company logos for title blocks, saved parameter presets, and saved job configurations.

By uploading User Content, you grant CAD60 a limited, non-exclusive, royalty-free licence to store, display, and process your User Content solely for the purpose of providing the Service to you. This licence terminates when you delete the User Content or your Account.

You represent and warrant that you own or have the necessary rights to upload your User Content, and that it does not infringe on any third party’s intellectual property rights or violate any applicable laws. CAD60 reserves the right to remove User Content that violates these Terms.

12. Disclaimers and Professional Responsibility

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Drawing Packs generated by the Service are intended as fabrication aids only. They are not a substitute for professional engineering review, structural certification, or compliance assessment. All drawings should be reviewed and verified by a suitably qualified professional before being used in construction, manufacturing, or any structural application.

CAD60 does not guarantee the accuracy, completeness, structural adequacy, or fitness of generated drawings for any particular purpose. You use the drawings entirely at your own risk. CAD60 accepts no responsibility for any loss, damage, or liability arising from the use of drawings generated by the Service.

13. Limitation of Liability

To the maximum extent permitted by applicable law, CAD60, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, or goodwill, whether incurred directly or indirectly, arising out of or in connection with your use of the Service.

In no event shall CAD60’s total aggregate liability to you for all claims arising out of or relating to the Service exceed the total amount you have paid to CAD60 in the twelve (12) months immediately preceding the event giving rise to the claim, or one hundred Australian Dollars (AUD $100), whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless CAD60 and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) your use of any drawings or files generated by the Service in construction, manufacturing, or any other application.

15. Third-Party Services

The Service integrates with and relies upon the following third-party services, each governed by their own terms of service and privacy policies:

  • Google — Authentication via Google OAuth (sign-in)
  • Stripe — Payment processing and subscription billing
  • PostHog — Product analytics (only with your explicit consent via the cookie consent banner)
  • Vercel — Application hosting and delivery
  • Neon — Database infrastructure
  • Resend — Transactional email delivery

CAD60 is not responsible for the practices, policies, or availability of any third-party services. Your use of third-party services is subject to their respective terms.

16. Privacy and Data

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described in the Privacy Policy.

In summary, we collect your account information (name, email via Google OAuth), drawing parameters you submit, uploaded logos, saved job configurations, and usage data. We do not sell your personal data to third parties.

17. Cookies and Analytics

The Service uses essential cookies for authentication and session management. These cookies are strictly necessary for the Service to function and cannot be disabled.

We also use optional analytics cookies (via PostHog) to understand how the Service is used and to improve it. Analytics cookies are only enabled if you provide explicit consent through the cookie consent banner. You can change your cookie preferences at any time. 18. Account Termination

By you: You may delete your Account at any time through your account settings. Upon deletion, your personal data, saved jobs, presets, and uploaded logos will be permanently removed. If you have an active Subscription, you must cancel it separately before deleting your Account.

By CAD60: CAD60 may suspend or terminate your Account at any time if you violate these Terms, engage in fraudulent activity, or if required by law. Where practicable, we will provide notice before termination. Upon termination for cause, you forfeit access to paid features immediately and no refund will be issued.

19. Service Availability and Modifications

CAD60 strives to maintain high availability but does not guarantee uninterrupted or error-free access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

CAD60 reserves the right to modify, update, or discontinue any feature or aspect of the Service at any time. We will use reasonable efforts to provide advance notice of material changes that significantly affect your use of the Service.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Queensland, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Queensland, Australia, for the resolution of any disputes arising out of or relating to these Terms or the Service.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

22. Changes to Terms

CAD60 may update these Terms from time to time. When we make changes, we will revise the “Last updated” date at the top of this page. For material changes that affect your rights or obligations, we will use reasonable efforts to notify you (for example, via email or a notice within the Service). Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
